Agreement to these terms
These Terms of Service govern access to dynamisathletic.com and purchases from Dynamis Apparel. By using the site, creating an account, or placing an order, you agree to these Terms and the Privacy, Shipping, and Returns & Refunds policies incorporated into them.
If you do not agree, do not use the site or place an order. You must be at least the age of majority where you live, or use the site with the permission and supervision of a parent or legal guardian.
Accounts
Provide accurate, current information and maintain the confidentiality of account credentials. You are responsible for activity performed through your account unless caused by Dynamis. Notify Support promptly if you suspect unauthorized access.
Dynamis may suspend or close an account used for fraud, abuse, unlawful activity, harassment, unauthorized resale, manipulation of rewards, or material violation of these Terms. Closing an account does not erase payment or order obligations already incurred.
Products and availability
Dynamis makes reasonable efforts to describe products accurately. Screen settings, lighting, manufacturing variation, and photography can affect color appearance. Measurements and fit guidance are estimates unless expressly guaranteed.
Products, variants, prices, promotions, and inventory may change without notice. Adding an item to a cart does not reserve inventory. Inventory is reserved only during the checkout process as supported by the store system, and an order remains subject to acceptance.
Pricing, payment, and taxes
Prices are displayed in the currency shown at checkout. Shipping, tax, duties, and other charges are displayed before payment when known. Stripe processes payment information; Dynamis does not store full card numbers.
If a material pricing or product error affects an order, Dynamis may cancel the affected item before shipment and issue a full refund, or contact the customer for approval of the corrected terms. Dynamis will not charge a corrected higher price without consent.
Order acceptance and cancellation
An order confirmation acknowledges receipt and is not a guarantee of acceptance. Dynamis may reject or cancel an order for unavailable inventory, suspected fraud, payment failure, pricing error, shipping restriction, purchase-limit violation, or another legitimate business reason. Amounts collected for cancelled items will be refunded to the original payment method.
Customer cancellation and address-change requests are handled under the Returns & Refunds Policy. Orders that have entered fulfillment may be unable to be changed or cancelled.
Shipping, returns, and refunds
Shipping estimates and delivery procedures are governed by the Shipping Policy. Return eligibility, exclusions, return costs, exchanges, refund timing, and damaged-item claims are governed by the Returns & Refunds Policy. Those policies form part of these Terms.
Rewards and membership
Points, membership tiers, early access, and rewards are promotional benefits, not cash, property, a bank account, or a gift card. Unless a specific offer says otherwise, points are personal, nontransferable, and have no cash value.
Dynamis may correct points issued in error, reverse points related to refunded or cancelled purchases, and remove points obtained through abuse. Current points and lifetime points may serve different purposes. Dynamis may change or end rewards features with reasonable notice where practicable, subject to applicable law and any specific redemption terms already accepted.
Acceptable use
You may not:
- Use the site for unlawful, fraudulent, abusive, or deceptive activity.
- Attempt to access another person's account, admin tools, source systems, or nonpublic data.
- Interfere with security, inventory, checkout, pricing, rewards, support, or site availability.
- Use automated tools to scrape, overload, copy, purchase, or reserve inventory without written permission.
- Upload malicious code or content that infringes another person's rights.
- Harass support personnel or submit knowingly false payment, delivery, return, or chargeback claims.
Intellectual property
The Dynamis name, logos, artwork, product photography, product designs, text, site design, and other content are owned by Dynamis or used with permission and are protected by intellectual-property laws. Personal, noncommercial browsing is permitted. No other license is granted without written permission.
Third-party services
The store relies on services such as Stripe, Supabase, Netlify, Shippo, and shipping carriers. Their own terms and privacy policies may apply when they process information or provide a service. Dynamis is not responsible for an independent third-party service beyond the extent required by law, but remains responsible for its own promises and legal obligations as the seller.
Disclaimers
To the fullest extent permitted by law, the site is provided on an as-available basis. Dynamis does not promise uninterrupted or error-free access. Apparel is not protective or medical equipment unless expressly identified as such. Product use, exercise, and training involve risks that customers must evaluate for themselves.
Nothing in these Terms excludes an express product promise or a warranty, remedy, or consumer right that cannot lawfully be excluded.
Limitation of liability
To the fullest extent permitted by law, Dynamis will not be liable for indirect, incidental, special, exemplary, or consequential losses arising from use of the site or products when those losses were not reasonably foreseeable. For a claim related to a purchase, Dynamis aggregate liability will not exceed the amount paid for the product giving rise to the claim.
These limits do not apply to fraud, willful misconduct, personal injury caused by negligence, or any liability or remedy that applicable law does not allow to be limited.
Governing rules and disputes
These Terms are governed by applicable U.S. federal law and the laws of the U.S. state where Dynamis has its principal place of business, without applying conflict-of-law rules. A dispute may be brought in a court with lawful jurisdiction. Nothing here prevents a consumer from using a forum or remedy that applicable law requires to remain available.
Before filing a claim, contact Support with the order number and a clear description of the issue so both sides have a reasonable opportunity to resolve it informally.
Changes and contact
Dynamis may update these Terms prospectively. The effective date will be updated, and material changes will receive additional notice when required. The Terms in effect when an order is placed continue to govern that order unless a later change is required by law or the customer agrees to it.
